These Terms of Use (“Legal Terms”) are a legally binding agreement between you (“You”, “User”) and My Advance (“Company”, “We”, “Us”, “Our”) governing your access to and use of the My Advance mobile application (the “App”), the website https://myadvance.co.ke (the “Website”), and any related products and services (collectively, the “Services”).
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you must stop using the Services immediately.

1. Our Services
My Advance provides a platform that may allow eligible users to request and receive salary advances and related services, subject to verification, approval, availability, and applicable laws and regulations.
The Services are provided for your personal use. You may not use the Services for unlawful purposes, resale, or commercial exploitation without our written approval.
We may limit access to the Services by person, geography, or other criteria at our discretion where legally permitted.
2. Eligibility and User Accounts
2.1 Age Requirement
The Services are intended for users who are at least 18 years old. If you are under 18, you must not use or register for the Services.
2.2 Account Registration
You may need to create an account to use the Services. You agree to:
- Provide accurate, current, and complete information
- Keep your login credentials confidential
- Be responsible for all activity on your account
You must notify us immediately if you suspect unauthorized access to your account.
2.3 No Social Sign-In
My Advance does not provide sign-in via Google or other third-party social sign-in providers.
3. Salary Advance Requests, Approval, and Disbursement
3.1 Requests and Approval
Submitting an advance request does not guarantee approval. We may approve, decline, or review requests based on factors including:
- Identity and employment verification
- Eligibility rules and risk checks
- Past repayment history
- System controls, fraud signals, and compliance requirements
We may request additional information before approving an advance note.
3.2 Disbursement
If approved, funds may be disbursed to your chosen payout method (such as bank account or mobile money). Disbursement speed can vary due to:
- Provider processing timelines
- System availability
- Verification or compliance checks
We are not responsible for delays caused by third-party payment providers.
3.3 Errors
If you believe there is an error in a disbursement or transaction, you must contact support as soon as possible with relevant details. Some errors may be time-sensitive.
4. Repayment, Deductions, Fees, and Taxes
4.1 Repayment Obligation
By accepting an advance, you agree to repay it according to the repayment terms shown in the App, including repayment date(s), fees (if any), and applicable charges.
4.2 Salary Deductions and Payment Methods
Repayment may occur through one or more methods, including:
- Salary deduction where supported and authorized
- Mobile money payments
- Bank transfers
- Other methods presented in the App
You authorize repayment processing based on the method you select or accept within the Services.
4.3 Fees and Charges
We may charge fees for the Services (such as service fees, processing fees, or late fees) as disclosed to you in the App before you confirm a transaction. Fees may vary by product, amount, and risk profile.
4.4 Late or Missed Repayments
If you do not repay on time, we may:
- Apply late fees (where disclosed and legally permitted)
- Restrict or suspend your access to further advances
- Take lawful recovery actions consistent with applicable requirements
5. Identity Verification and Compliance
To comply with legal and regulatory obligations, we may perform verification checks and request documentation. This may include:
- Identity details
- Employment and salary information
- Additional verification documents where required
If you refuse to provide required information or fail verification, we may limit or deny Services.
6. User Responsibilities and Representations
By using the Services, you represent and warrant that:
- You are at least 18 years old and have legal capacity to enter these Legal Terms
- All information you provide is true, accurate, current, and complete
- You will update information promptly if it changes
- You will use the Services only for lawful purposes
- You will not attempt to circumvent security or misuse the Services
- You understand that advance approval is not guaranteed
If you provide false or misleading information, we may suspend or terminate your account.
7. Prohibited Activities
You agree not to:
- Use the Services for fraud, money laundering, or illegal activity
- Provide false identity, employment, or salary information
- Attempt to reverse engineer, decompile, or exploit the App or systems
- Interfere with security features or access controls
- Use automated scraping, bots, or data extraction tools
- Attempt unauthorized access to other users’ accounts or Company systems
- Abuse support channels or submit false claims
- Use the Services to harass, threaten, or harm others
We may take action including suspension, termination, and reporting to relevant authorities where required.
8. Third-Party Services and Payment Channels
The Services may rely on third-party infrastructure (for example, hosting providers, SMS providers, payment providers, banks, and mobile money operators). Your use of those channels may be subject to the third party’s own terms and policies.
We do not control third-party systems and are not responsible for failures, outages, or delays caused by third parties.
9. Intellectual Property Rights
We own or license all rights to the Services, including the App, Website, content, software, branding, logos, and trademarks (“Content” and “Marks”).
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal purposes, subject to these Legal Terms. You may not copy, modify, distribute, sell, or exploit our Content or Marks without our prior written permission.
10. App License and Device Requirements
If you use the App, we grant you a limited license to install and use it on devices you own or control, only as permitted by these Legal Terms.
You must not:
- Modify the App
- Reverse engineer or attempt to derive source code, except where expressly allowed by law
- Use the App to develop competing products
- Remove proprietary notices
App availability and functionality may depend on your device, network, and app store policies.
11. Privacy Policy
Our Privacy Policy describes how we collect and use personal data. By using the Services, you agree to our Privacy Policy.

We are not liable for interruptions or inability to access the Services, except where the law requires otherwise.
13. Suspension and Termination
We may suspend or terminate your account or access to the Services if:
- You breach these Legal Terms
- We suspect fraud, misuse, or illegal activity
- You fail required verification
- We are required to do so by law or regulators
Upon termination, your rights to use the Services stop immediately. You remain responsible for any repayment obligations already incurred.
14. Disclaimers
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent allowed by law:
- We do not guarantee uninterrupted service
- We do not guarantee that you will be approved for any salary advance
- We do not guarantee that disbursements will be immediate
Nothing in these Legal Terms is intended to exclude obligations that cannot be excluded under applicable law.
15. Limitation of Liability
To the maximum extent permitted by law, the Company and its officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising from or related to your use of the Services.
Where liability cannot be excluded under applicable law, it will be limited to the minimum extent permitted.
16. Indemnification
You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your misuse of the Services
- Your breach of these Legal Terms
- Your violation of applicable law
- Your violation of third-party rights
17. User Data and Security
You are responsible for maintaining the confidentiality of your account details and ensuring your device security. We take reasonable steps to protect data, but no system is completely secure.
You are responsible for maintaining accurate contact details to receive important notices.
18. Electronic Communications and Signatures
You agree that communications via the App, Website, email, SMS, or other electronic means satisfy legal requirements for written communications where permitted.
You agree that your electronic actions (for example clicking “Accept” or “Confirm”) can constitute a valid electronic signature.
19. Governing Law and Dispute Resolution
19.1 Governing Law
These Legal Terms are governed by the laws of the United Republic of Tanzania.
19.2 Dispute Resolution
If a dispute arises, the parties will first attempt to resolve it informally by contacting support.
If informal resolution fails, disputes will be resolved in the competent courts of Tanzania, unless another lawful dispute resolution mechanism is mandatory or agreed in writing.
20. Miscellaneous
- If any provision of these Legal Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver.
- We may assign our rights and obligations under these Legal Terms as permitted by law.
